Free Trial / End User License Agreement (EULA) 

PLEASE READ CAREFULLY: This EULA is a legal Agreement between Smart Car Technologies Pty Ltd (SCT) and you (either an individual or a single entity) and governs your use of the free trial version of the SpeedAlertTM LIVE software, related software components, files, information and documentation (all of which are referred to herein as the "Free Software"). This Agreement takes precedence over any other agreement embedded within the software. 
BY DOWNLOADING, INSTALLING OR USING THE FREE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. If you do not agree with any term or condition, do not download, open, install or use the Free Software. 
THE FREE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL SCT OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE FREE SOFTWARE, EVEN IF SCT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
THE FREE SOFTWARE IS BELIEVED TO CONTAIN DEFECTS AND ONE PURPOSE OF THIS FREE TEST LICENSE IS TO IDENTIFY DEFECTS. YOU ARE ADVISED TO SAFEGUARD IMPORTANT DATA, TO USE CAUTION AND TO NOT RELY IN ANY WAY ON THE CORRECT FUNCTIONING OR PERFORMANCE OF FREE SOFTWARE.
Confidentiality: The Free Software is Confidential Information. You will not disclose the Free Software or any comments regarding the Free Software to any third party without the prior written approval of SCT. You will maintain the confidentiality of Free Software with at least the same degree of care that you use to protect your own confidential and proprietary information, but not less than a reasonable degree of care under the circumstances. You will not be liable for the disclosure of any Confidential Information which is: (a) in the public domain other than by a breach of this Agreement on your part; or (b) rightfully received from a third party without any obligation of confidentiality; or (c) rightfully known to you without any limitation on use or disclosure prior to its receipt from SCT; or (d) generally made available to third parties by SCT without restriction on disclosure. 
License: SCT grants you the right to install the Free Software onto a single mobile phone for your personal use. You will not use, copy, modify, sell or transfer any part of the Free Software except as provided in this Agreement. This is Free test software, and as such, WILL CONTAIN BUGS AND MAY CAUSE DATA LOSS.
Restrictions: Except as specifically permitted in writing, you may not: (a) Copy the Free Software except as provided in this Agreement or elsewhere by SCT. (b) Sublicense or permit simultaneous use of the Free Software by more than one user. (c) Reverse engineer, decompile, or disassemble the Free Software. (d) sell, rent, lease, or lend the Free Software. You may NOT transfer the Free Software under any circumstances. 
Ownership and Copyright of Free Software: Title to the Free Software and all copies thereof remain with SCT. The Free Software is copyrighted and is protected by Australian copyright laws and international treaty provisions. You will not remove copyright notices from the Free Software. You agree to prevent any unauthorized copying of the Free Software. Except as expressly provided herein, SCT does not grant any express or implied right to you under SCT patents, copyrights, trademarks, or trade secret information. 
Technical Support. Technical support is not provided for the Free Software on an individual basis. You may find the user-to-user support forums at http://www.speedalert.com.au/forum helpful in addressing any issues.
Personal Information and Privacy.  We may ask you to provide certain information about you during the Free Software downloading process.  All personal information that you provide to us will be governed by SCT?s Privacy Policy, Also, we'd like to get your feedback on the Free Software so we can keep improving it.  You agree to answer questions regarding the Free Software posed by us from time to time.
Term of this Agreement: If not terminated sooner by SCT, this license to use Free Software expires one year after the date of delivery of Free Software from SCT to you, after which you shall either return all Free Software to SCT or shall certify that the Free Software has been destroyed, with no copies of any kind remaining. SCT may terminate this license at any time without any liability.
Modification.  SCT may modify the Free Software and this Free Agreement with notice to you either in email or by publishing content on the SCT website, In the event SCT modifies the Free Software or the Free Agreement, you may terminate this Free Agreement and cease using of the Free Software.  SCT may terminate the Free Agreement or the Free Software service at any time, with or without notice.
No Obligation Created: Provision of any Free Software under this Agreement is experimental and shall not create any obligation for SCT to continue to develop, productize, support, repair, offer for sale or in any other way continue to provide or develop Free Software either to you or to any other party.
